PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE AND DISCLAIMER CAREFULLY James Anthony Furniture reserves the right, at any time, to modify, alter or update these terms of use, and you agree to be bound by such modifications, alterations or updates on subsequent visits.

Payment
Deposit of any product is 30% upon order with 70% due on satisfactory delivery. Payments may be made by cheque drawn on a UK bank made payable to 'James Anthony Furniture' or by an inter-bank transfer.

Delivery
We aim to give you at least 7 days notice of the dispatch date ("Dispatch Date"). It is your responsibility to provide reasonable, safe and proximate access to the delivery address (the "Premises") for the delivery personnel and their vehicle failing which we reserve the right to charge you for any additional costs incurred in effecting delivery.
Delivery within the UK will be by a carrier nominated by us.
Without prejudice to the statutory rights afforded to consumers under English law, James Anthony Furniture accepts no liability for any failure to ship products where this results from its inability to do so or its decision on reasonable grounds not to do so, provided that it takes all reasonable steps to notify you within 14 days of order placement that products will not be shipped as ordered. In such cases, James Anthony Furniture will not process any payment or will immediately refund any payment made in full. It is your responsibility to ensure that you order from James Anthony Furniture with sufficient lead time to prevent any loss or disappointment resulting from such non-shipment.

Cancellation
Deposits are non refundable if order is cancelled after 7 days of signing order.

Taxes
If you are a resident of the European Union, VAT will be added. If you are a non-EU resident, VAT will not be charged although you will bear responsibility for local import charges and taxes levied in your country of residence.

Title and Risk
We retain ownership of any products ordered until we have received full payment for such products.

Returns
You must notify us of any shortages, damages, defect in quality or conditions of the product or failure of the product to correspond with the specification within a reasonable period of time. We would normally expect to receive such response within seven (7) days of the date of delivery or where the defect or failure was not apparent or reasonable inspection, within seven (7) days after discovery of the defect or failure. Failure to notify us within the reasonable time period will result in the loss of your right to reject the goods and your right to have the defects remedied subject to our absolute discretion. Your statutory rights are not affected.

Warranty for Products Supplied by James Anthony Furniture
James Anthony Furniture excludes all warranties, conditions and implied terms to the maximum extent permitted by applicable law. Except in respect of death or personal injury caused by James Anthony Furniture negligence, James Anthony Furniture excludes all liability arising out of or in connection with this contract to the maximum extent permitted by applicable law.

Third Party Products
We are not liable for any third party products example appliances and the terms and conditions of the supply of third party products are subject to the relevant suppliers' terms and conditions.

Governing Law
Any contract made between you and James Anthony Furniture is deemed to have been concluded in England and will be interpreted, construed and enforced in all respects in accordance with the laws of England and Wales and you and James Anthony Furniture irrevocably submit to the non-exclusive jurisdiction of England and Wales.

Force Majeure
Our performance of any part of a contract with you is subject to variation or cancellation and the grant of an extension of time from any cause arising from an act of God, war, strikes, lock-outs, flood, drought or other cause of any nature whatsoever beyond our control or owing to inability and time to procure materials, labour or any articles at all and you agree to accept increased prices for the products due to any of the aforesaid reasons. In all circumstances time is not of the essence of the contract.
